Tobacco's recent wins
A three-judge panel of the 4th Circuit Court of Appeals ruled that the FDA lacks jurisdiction to regulate nicotine as a drug, and the full court later rejected the government's appeal.
A federal judge ruled that the Environmental Protection Agency had erred in classifying second-hand tobacco smoke as a dangerous carcinogen.
An appellate judge threw out five class-action suits, saying the tobacco industry cannot be blamed for individuals' addiction to cigarettes.
