New CRD (Capital Regional District) law permits Bylaw Officers to search without warrant.(Vancouver Island, British Columbia) Passed on 27 January 1999, CRD Bylaw 2681 reads in part: ........The Offices of Chief Bylaw Enforcement Officer, Bylaw Enforcement Officer, and Assistant Bylaw Enforcement Officer, are established and the person or persons appointed to the positions are authorized to enforce any of the regulations or directions or Bylaws of the Regional Board and are authorized to enter at all reasonable times, on any property, as permitted in section 268 of the Municipal Act to ascertain whether any of the regulations or directions or Bylaws of the Regional Board are being observed. (this includes:) The Offices of Medical health Officer, Director of Health Protection and Environmental Programs, Environmental Health Officer, Public Health Educator, and Tobacco Enforcement Officer in the Capital Health Region are established and the person or persons appointed to the positions are hereby authorized to enforce the following Bylaws and any subsequent amendments, and are authorized to enter at all reasonable times, on any property, as permitted in section 268 of the Municipal Act, to ascertain whether the regulations prescribed by the following Bylaws, and any subsequent amendment are being observed: (including:) Capital Regional District Bylaw No. 2401 "Capital Regional District Clean Air Bylaw No. 1, 1996". Section 268: If a council has authority to direct that a matter or thing be done by a person or that regulations be observed, the council may, by bylaw, authorize officers, employees and agents of the municipality to enter at all reasonable times on any property that is subject to the direction to ascertain whether the requirement is being met or the regulations are being observed. **** |
