An Oregon court has rejected a medical cost claim against the tobacco industry.
This isn’t so much “good news” as … just very interesting, breaking the trend. It really does smell an awful lot like people getting sick of antismoking. They’re relying on the definition of "harm" in tort law, but frankly, if the court had wanted to press it, then they could have used a twist of junk science or otherwise found some way of holding the tobacco companies responsible. I really believe that antismokers have flouted the law too many times … and judges don’t like that.
